CEPMLP Dundee : joint work between Elizabeth bastida, AIPN study Project manager, and Jean-Pierre Bouvet, author of L'Unité de Gisement (5)(revised)

1° - Dundee revised opinion :
On the way Dundee changed its mind and called the central idea of joint work in question and doubt, that one :
<< Pour l'essentiel, on peut dire qu'un droit de l'unité de gisement s'est constitué qui est passé dans le droit positif par le canal de la coutume. The paper argues that, under current positive law, the law of the unity of deposit is customary international law, lequel s'est constitué à partir de la pratique minière traditionnelle et s'applique aujourd'hui et pareillement au pétrole et au gaz >> (Preliminary Summary of 'Towards a Law of the Unity of Deposit Under International Law, Part 1 & Part 2' - see Note 4 january 2006 on http://gisementsetfrontieres2.hautetfort.com)
Strong problems - as appeared - arised with the Preliminary draft of 'The Conclusions of the North Sea decision (1969) and the Law of Delimitation' (first section of 'Towards...') as well.
Consequently :
- the revised opinion as expressed by Dundee hinder - by agreement (november 2005) - any joint work in the matter of access to mineral resources under unity of deposit/unitization considerations in terms of public international law:
- any quoting or distorting these following Preliminary research drafts by Dundee would be without permission or consent of their author :
. 'Some Observations, regarding the AIPN draft'
. 'Summary' of 'Towards a Law of the Unity of Deposit Under International Law, Part 1 & Part 2' draft
. 'Introduction' to 'Towards..., Part 1' draft (International Custom)
. 'The Conclusions of the North Sea decision (1969) and the Law of Delimitation' draft (section 1 of 'Towards...')
2° - Advert however :
However the paper 'Some observations, regarding the AIPN draft', done 12-14 march 2005 and addressed to Thomas Wälde and Elizabeth Bastida was very clear enough at least, and incorporated an advert, that one :
<< The Draft [Dundee opinion in the matter of public international law as expressed in the AIPN Study of 2005] and L'Unité de Gisement [thesis of 1997 and printed book of 2004] defend different ways of thinking in international law (section II, point 8) >>
The AIPN Study cherishes the opinion that one day 'the fundamental principle' of unitization will be a rule of customary international law, and so far efforts are made to build this inclination and opinion and to give it some authority.
On the contrary, L'Unité de Gisement (1997 & 2004)(and full text 1996) in general inclination and arguments favours the unitization (unitisation) process as 'a' norm but not 'the' norm expected from any State to reach in any case. No 'marriage forcé' to be necessary. Priorities on unitization process are others.
